Is Aadhaar Mandatory in India?
Aadhaar is not universally mandatory for all services in India. The Supreme Court of India in its landmark 2018 judgement (Justice K.S. Puttaswamy vs Union of India) upheld the constitutional validity of Aadhaar but placed clear restrictions on where it can be made compulsory.
The court ruled that Aadhaar is mandatory only where Parliament has specifically enacted a law requiring it, primarily for government subsidies and income tax filings.
Where Aadhaar Is Mandatory
The following services legally require Aadhaar as per the Aadhaar Act and subsequent amendments:
1. Income Tax and PAN Card
- PAN-Aadhaar linking — Mandatory under Section 139AA of the Income Tax Act
- Filing Income Tax Returns (ITR) — Aadhaar or Aadhaar enrolment ID required
- New PAN card application — Aadhaar is required
Non-linking leads to PAN becoming inoperative. See our PAN-Aadhaar linking guide for steps.
2. Government Subsidies and Welfare Schemes (DBT)
Aadhaar is mandatory for receiving benefits under Direct Benefit Transfer (DBT) schemes:
- LPG subsidy (PM Ujjwala Yojana)
- MGNREGA wages
- PM-KISAN payments
- Scholarships
- Pension schemes (NSAP)
- Ration card / PDS distribution (in most states)
3. Opening Bank Accounts (with Exceptions)
- Aadhaar is required for Jan Dhan Yojana accounts
- Banks accept Aadhaar for KYC under PMLA rules
- Small accounts can be opened without Aadhaar using other ID proofs
- For regular accounts, Aadhaar is one of the accepted KYC documents (not the only one)
4. EPFO and Labour Welfare
- EPF (Employee Provident Fund) — Aadhaar-UAN linking is mandatory
- ESIC — Aadhaar required for registration
5. Government Examinations
Many government recruitment exams require Aadhaar for:
- Registration and application
- Biometric verification at exam centres
- UPSC, SSC, banking exams may ask for Aadhaar
Where Aadhaar Is Voluntary (Cannot Be Forced)
Based on the Supreme Court ruling, Aadhaar cannot be mandated for:
1. Mobile SIM Cards
- Telecom companies cannot insist on Aadhaar for issuing SIM cards
- The Supreme Court struck down the requirement in 2018
- You can use passport, voter ID, or driving licence instead
2. School and College Admissions
- Schools and colleges cannot deny admission for lack of Aadhaar
- This applies to both government and private institutions
- CBSE and other boards have clarified that Aadhaar is not mandatory for exams
3. Bank Accounts (Regular)
- While Aadhaar is commonly used for KYC, banks must accept other valid ID proofs
- Passport, voter ID, driving licence are equally valid
- Banks cannot refuse service solely because you don't have Aadhaar
4. Hospital and Medical Services
- No hospital (government or private) can deny treatment for lack of Aadhaar
- Government hospitals must provide emergency treatment regardless
5. Private Services
- Private companies cannot mandate Aadhaar for services
- Hotel check-ins, courier services, etc. must accept alternative IDs
- Aadhaar authentication by private entities is regulated under the Aadhaar Act

Exceptions and Special Cases
Who Is Exempt from Aadhaar?
- NRIs who have never resided in India — Not required to have Aadhaar (but can now apply if eligible)
- Residents of J&K, Assam, Meghalaya — Special provisions may apply for certain schemes
- Senior citizens and disabled persons — Relaxed biometric requirements; alternative methods available
What If You Don't Have Aadhaar?
For mandatory services (ITR, subsidies), you can use your Aadhaar Enrolment ID (EID) while your Aadhaar is being processed. For voluntary services, use alternative ID proofs.
Important Tips
- Know your rights — No private company can force you to provide Aadhaar
- For government subsidies, Aadhaar is essential — Ensure your Aadhaar is linked to your bank account for DBT
- PAN-Aadhaar linking is critical — Non-linking makes PAN inoperative, blocking tax filings and financial transactions
- Keep alternative IDs ready — Passport, voter ID, and driving licence are accepted almost everywhere Aadhaar is not mandatory
- Aadhaar Enrolment ID works — If Aadhaar is pending, the 14-digit EID is accepted for mandatory services
