Property registration is the legal process of recording a property transaction (sale, gift, lease, mortgage) with the government. Under the Registration Act, 1908, any transfer of immovable property valued above ₹100 must be registered with the Sub-Registrar Office (SRO).

Without registration, the property transfer has no legal validity. The registered sale deed is your primary proof of ownership.

Step-by-Step: Online Property Registration

Step 1: Draft the Sale Deed

  • Hire a lawyer to draft the sale deed
  • Include property details, buyer/seller info, consideration amount, terms
  • Ensure property description matches revenue records

Step 2: Calculate & Pay Stamp Duty

  • Check circle rate / guideline value on the state IGR portal

  • Pay stamp duty online or buy e-Stamp paper from SHCIL
  • Keep the e-Stamp certificate or payment receipt

Step 3: Book Appointment Online

  • Visit your state's e-registration portal
  • Register/login with your mobile number
  • Select "Property Registration" or "Document Registration"
  • Choose the Sub-Registrar Office (SRO) based on property location
  • Book a slot (usually available 3-15 days ahead)

Step 4: Upload Documents Online (Pre-Registration)

  • Enter buyer/seller details, property details, consideration value
  • Upload scanned copies of required documents
  • Upload passport photos of all parties and witnesses

Q1. Is physical presence mandatory for property registration?

Q2. Can NRIs register property in India?

Yes. NRIs can buy and register residential and commercial property in India. They can execute a Power of Attorney for someone in India to complete the registration. The POA must be notarized by the Indian embassy/consulate.

Q3. What is the time limit for property registration?

A sale deed must be registered within 4 months from the date of execution. Late registration (up to 4 more months) is possible with a penalty up to 10x the registration fee.

Q4. Can I register property online without visiting the SRO?

Currently, physical presence at the SRO is mandatory in all states for final registration (biometric verification). The online process only covers appointment booking, document upload, and pre-verification.

Q5. What if the seller refuses to come for registration?

You can file a suit for specific performance in civil court. If you have a registered agreement to sell, the court can direct the seller to complete registration.

Q6. Is agreement to sell the same as sale deed?

No. An agreement to sell is a promise for future transfer. A sale deed is the actual transfer document. Only a registered sale deed transfers ownership.

Q7. Can property registration be done on any day?

Registration offices are open Monday to Saturday (except gazetted holidays). Some states have extended Saturday hours. Sundays are closed.
