Can I buy a property without RERA registration?
Legally, a builder cannot sell a project that requires RERA registration without registering it. If you buy such a property, you lose RERA protections โ no complaint mechanism, no escrow, no penalty on delays.
What is the penalty for builders selling without RERA?
Under Section 59 of RERA Act: imprisonment up to 3 years and/or fine up to 10% of the estimated project cost. For continued violations, the imprisonment can extend to 3 years for each additional offence.
Does RERA cover resale/secondary market?
RERA primarily covers new projects being sold by promoters/builders. Resale between individuals is not covered under RERA, but the property must still be in a RERA-registered project (if applicable).
How long is RERA registration valid?
The registration is valid until the project completion date declared by the builder. The builder can apply for extension (up to 1 year) with valid reasons. After that, a fresh application is needed.
Can I file a RERA complaint even after possession?
Yes. You can file complaints regarding structural defects within 5 years of possession. For other issues (documentation, common areas, etc.), complaints can be filed as long as the issue persists.
What is the RERA agent registration?
Real estate agents (brokers) must also register with the state RERA Authority. Their registration number should be displayed in all property listings. Unregistered agents face a fine of up to โน10,000 per day of violation.
