What is Circle Rate / Guideline Value?

Circle rate (also called guideline value, ready reckoner rate, or collector rate) is the minimum property value per square foot/metre set by the state government for a specific area. No property can be registered below this rate — even if the actual transaction value is lower.

Different states use different terms:

  • Delhi, Haryana, UP: Circle Rate
  • Maharashtra: Ready Reckoner Rate
  • Tamil Nadu, Kerala: Guideline Value
  • Karnataka: Guidance Value
  • Gujarat: Jantri Rate
  • Rajasthan: DLC Rate (District Level Committee Rate)
  • West Bengal: Market Value

Why Circle Rate Matters

Circle rate directly affects three major financial aspects of property ownership:

1. Stamp Duty Calculation

Stamp duty is calculated on whichever is higher — the actual sale price or the circle rate value. If you buy a property for ₹50 lakh but the circle rate value is ₹60 lakh, stamp duty is charged on ₹60 lakh.

2. Capital Gains Tax (for Seller)

Under Section 50C of the Income Tax Act, if the actual sale price is less than the circle rate value, the circle rate value is deemed as the sale consideration for capital gains calculation. This can increase the seller's tax liability.

Section 50C relaxation: If the difference between actual price and circle rate is ≤10% of the circle rate, the actual price is accepted (no deemed adjustment).

3. Tax Implications for Buyer

Under Section 56(2)(x), if a buyer purchases property below circle rate (by more than ₹50,000), the difference is taxed as "income from other sources" in the buyer's hands.

Impact on Property Registration

When registering a property:

  1. Sub-Registrar checks the transaction value against circle rate
  2. If transaction value ≄ circle rate → Registration proceeds normally, stamp duty on transaction value
  3. If transaction value < circle rate → Registration may still proceed, but stamp duty is charged on circle rate value
  4. The Sub-Registrar can refuse registration if the declared value seems fraudulent

Practical Example

Buying a flat in Noida, UP:

  • Flat area: 1,200 sq. ft.
  • Agreed price: ₹55,00,000
  • Circle rate: ₹50,000/sq. ft. → Circle rate value = ₹60,00,000
  • Stamp duty calculated on: ₹60,00,000 (circle rate value is higher)
  • Stamp duty (7% for male): ₹4,20,000
  • Registration (1%): ₹60,000
  • Total registration cost: ₹4,80,000

Impact on Capital Gains Tax

For Seller

If you sell below circle rate (Section 50C):

  • Deemed sale consideration = Circle rate value (not actual price)
  • Capital gain calculated on deemed value → Higher tax
  • Exception: If difference is ≤10% of circle rate, actual price is accepted

For Buyer

If you buy below circle rate by more than ₹50,000 (Section 56(2)(x)):
