What is Consumer Forum?

A Consumer Forum (now called Consumer Disputes Redressal Commission) is a quasi-judicial body set up under the Consumer Protection Act, 2019 to resolve disputes between consumers and businesses. If you've been cheated, received defective goods, or experienced deficiency in service, you can file a complaint in the consumer forum.

Consumer forums operate at three levels:

Who Can File a Consumer Complaint?

  • Any consumer who has purchased goods or availed services for personal use
  • Legal heirs of a deceased consumer
  • Parent or guardian on behalf of a minor
  • Consumer associations registered under law
  • Central or State Government on behalf of consumers

Who is a consumer? Anyone who buys goods or hires services for a consideration (payment). This includes online purchases, e-commerce, telecom services, banking, insurance, healthcare, housing, and more.

What Can You Complain About?

  • Defective goods — Product doesn't work, manufacturing defect, wrong product delivered
  • Deficiency in service — Poor service quality, delay, negligence (hospitals, banks, telecom, insurance)
  • Unfair trade practices — False advertising, misleading claims, hidden charges
  • Overcharging — Charging above MRP or agreed price
  • Product liability — Harm caused by defective product

How to File Consumer Complaint Online (edaakhil.nic.in)

Step 1 — Register on E-Daakhil Portal

  1. Visit edaakhil.nic.in
  2. Click "Sign Up" (for Complainant)
  3. Enter your details — name, email, mobile number
  4. Verify via OTP
  5. Create password and log in

Step 2 — File a New Complaint

  1. After login, click "File Complaint"
  2. Select the appropriate commission:
    • District Commission — for claims up to ₹1 crore
    • State Commission — for claims ₹1 crore to ₹10 crore
    • National Commission — for claims above ₹10 crore
  3. Select the state and district where:
    • The opposite party (business/seller) is located, OR
    • The transaction happened, OR
    • You (the consumer) reside

Step 3 — Fill Complaint Details

  1. Complainant details — Name, address, contact, Aadhaar
  2. Opposite party details — Name of the company/seller, address, contact (as many details as possible)
  3. Complaint description — Describe the issue clearly:
    • What you purchased/service availed
    • When (date of purchase/service)
    • What went wrong
    • What relief you're seeking (refund, replacement, compensation)
  4. Relief sought — Specify the amount of compensation or type of relief

Step 4 — Upload Documents

Upload supporting documents (PDF format):

  • Purchase proof — Bill, invoice, receipt, order confirmation (online orders: screenshot of order)
  • Communication records — Emails, messages, complaint letters exchanged with the company
  • Product evidence — Photos/videos of defective product
  • Bank/payment proof — Transaction details, payment screenshot
  • Identity proof — Aadhaar card or other ID
  • Affidavit — Sworn statement verifying the facts (required)
  • Vakalatnama — If filing through a lawyer (optional — you can represent yourself)

Step 5 — Pay the Fee

Step 6 — Submit & Track

  1. Review all details and click "Submit"
  2. Note your case number / diary number
  3. Track status at edaakhil.nic.in → "Track Case"

How to File Offline

  1. Write the complaint on plain paper (or use a typed format)
  2. Include: complainant details, opposite party details, facts of the case, documents list, relief sought
  3. Attach an affidavit on a ₹10 stamp paper (notarized)
  4. Attach all supporting documents (self-attested copies)
  5. Pay the fee via demand draft
  6. Submit 3 copies (for forum, opposite party, and your record) at the District Consumer Commission office

Alternative: Consumer Helpline (Before Filing)

Before going to consumer forum, try the National Consumer Helpline:

  1. Call 1800-11-4000 (toll-free) or 1915 (short code)
  2. Or visit consumerhelpline.gov.in
  3. Register a complaint online — the helpline mediates with the company
  4. Many complaints get resolved at this stage without going to forum
  5. You can also use the NCH app available on Google Play

This is a mediation service, not a legal proceeding. If the company doesn't cooperate, proceed to consumer forum.

  2. Preserve all evidence — Keep bills, receipts, screenshots, and communication records. Don't discard the defective product
  3. No lawyer needed — You can argue your own case in consumer forum. It's designed to be consumer-friendly and doesn't require legal representation
  4. File on time — Complaint must be filed within 2 years from the date of cause of action. Don't delay
  5. Be specific about relief — Clearly mention the compensation amount or specific relief (refund/replacement) you're seeking

Frequently Asked Questions

Do I need a lawyer to file in consumer forum?

No. Consumer forums are designed for self-representation. You can file and argue the case yourself. However, for complex cases or higher-value claims, a lawyer may be helpful.

Can I file a consumer complaint for online purchases?

Yes. E-commerce purchases from Amazon, Flipkart, or any online platform are fully covered under the Consumer Protection Act, 2019. You can file based on your location (where you placed the order from).

What if the company is in a different city?

Under the 2019 Act, you can file the complaint where you reside — you don't have to travel to the company's location. This is a major consumer-friendly provision.

Is there a minimum claim amount for consumer forum?

No. There is no minimum amount. You can file a complaint even for small amounts. The fee is as low as ₹200 for claims up to ₹5 lakh.

Can I file a complaint against a government hospital or service?

Yes. Government hospitals, telecom services (BSNL), railways, and other government services are covered if you paid for the service. Free services may not be covered as there's no "consideration."

What compensation can I get?

The forum can order: refund of amount paid, replacement of goods, compensation for mental agony and harassment, litigation costs, and punitive damages in some cases. Compensation depends on the facts and evidence.

Can I file RTI to check status of my consumer case?

Yes. You can file an RTI application to the consumer commission to get information about your case status, though the e-daakhil portal also provides online tracking.
